    Welcome to Kpop Velvet LLC. These Terms of Service (“Terms”) govern your access to and use of shop@kpopvelvet.com (the “Site”) and any purchases made through it. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

  • You represent that you are at least the age of majority in your state of residence, or that you have given us your consent to allow any of your minor dependents to use this site.

  • All products are subject to availability. We reserve the right to limit quantities, cancel orders, or discontinue products at any time without notice. While we strive for accuracy, product images are for reference; actual packaging or minor inclusions may vary based on manufacturer updates.

    • Pre-order items are not in stock at the time of purchase.

    • Estimated Ship Dates: These are estimates provided by labels/distributors and are subject to change due to production or logistics delays.

    • Combined Shipping: Orders containing both in-stock and pre-order items will ship together once all items are available.

    • Final Sale: All pre-orders are considered final sale.

    • All prices are in USD.

    • Texas Sales Tax: As a Texas-based business, we are required by law to collect sales tax on all orders shipped to addresses within the State of Texas.

    • Errors: We reserve the right to correct pricing errors and cancel affected orders.

    • International: International customers are responsible for all customs duties, VAT/GST, and local brokerage fees.

  • By placing an order, you authorize Kpop Velvet LLC (and our third-party payment processors) to charge your selected payment method for the full order total, including applicable taxes and shipping fees.

    • Shipping times are estimates and not guarantees.

    • Risk of Loss: Once we hand your package to the carrier (USPS, UPS, etc.), the risk of loss and title for the items pass to you. We are not responsible for packages stolen after confirmed delivery.

  • A. Policy: To maintain the collectability of our products, all sales are final. We do not accept returns or exchanges.
    B. Non-Returnable Items: Includes opened/unsealed albums, photocards, randomized/blind-box items, and limited edition merchandise.
    C. Damaged or Incorrect Items: If your order arrives damaged or incorrect, you must contact us at     shop@kpopvelvet.com within 7 days of delivery. You must provide your order number and clear photo/video evidence of the defect or error for a resolution.

    • Ownership: All content included on the Site—such as text, custom graphics, logos, button icons, images, digital downloads, and data compilations—is the property of Kpop Velvet or its content suppliers and is protected by United States and international copyright, trademark, and intellectual property laws.

    • Limited License: You are granted a limited, non-exclusive, and non-transferable license to access the Site for personal, non-commercial shopping use only.

    • Prohibited Use: Any other use—including the reproduction, modification, distribution, transmission, republication, or display of the content on this Site—is strictly prohibited without prior written consent from Kpop Velvet.

    • Trademarks: The Kpop Velvet LLC name and logo may not be used in connection with any product or service that is not ours, in any manner that is likely to cause confusion among customers.

  • These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law principles.

  • Any dispute arising from these Terms shall be resolved through binding arbitration in Waco, Texas. You agree to waive your right to participate in a class-action lawsuit or class-wide arbitration.

    • Order Limitations: To ensure fair access for all fans, we reserve the right to limit quantities purchased per person, per household, or per order.

    • Right to Cancel: We reserve the right to refuse or cancel any order we suspect is placed by dealers, resellers, distributors, or bots.

    • Policy Abuse: If we detect patterns of "friendly fraud," frequent chargeback abuse, or the use of automated purchasing tools, we reserve the right to permanently ban the associated account and shipping address.

    • Promotion Rules: Promo codes cannot be combined unless explicitly stated. We reserve the right to revoke or modify any promotion at any time without prior notice.

  • By using this Site, you agree not to:

    • Automated Use: Use any "bots," spiders, scripts, or automated tools to access the Site, scrape content, or bypass our purchasing limits.

    • Fraudulent Activity: Provide false information, use a stolen credit card, or attempt to impersonate another person or entity.

    • Security Interference: Attempt to breach the security of the Site, upload viruses, or interfere with the website’s hosting and servers.

    • Commercial Resale: Purchase items for the sole purpose of commercial resale without our express written permission.

    • Harassment: Use our contact forms or community spaces to harass, abuse, or threaten Kpop Velvet LLC staff or other customers.

    • External Providers: Our store is hosted on a third-party platform (such as Square) and uses third-party services for payment processing (e.g., Shop Pay, PayPal), shipping (e.g., USPS, UPS, FedEx), and marketing.

    • Independence: We do not own or control these third parties. Your use of these services may be subject to their own separate terms and privacy policies.

    • No Liability: Kpop Velvet is not responsible for any issues arising from third-party services, including but not limited to payment processing errors, data breaches on third-party servers, or carrier-related shipping delays.

    • Links to Other Sites: Our site may contain links to outside websites (like an artist's official YouTube or a label's site). We do not endorse or take responsibility for the content or safety of these external sites.

  • THE SITE AND ALL PRODUCTS AND SERVICES DELIVERED TO YOU THROUGH THE SITE ARE (EXCEPT AS EXPRESSLY STATED BY US) PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE.

    TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, KPOP VELVET DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SITE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT PRODUCT DESCRIPTIONS ARE 100% ACCURATE AT ALL TIMES.

  • TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, IN NO EVENT SHALL KPOP VELVET, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SITE OR PRODUCTS PURCHASED THROUGH THE SITE.

    THIS INCLUDES, BUT IS NOT LIMITED TO, LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. KPOP VELVET’S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES OR PRODUCTS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO KPOP VELVET FOR THE SPECIFIC PURCHASE GIVING RISE TO THE LIABILITY.

  • You agree to indemnify, defend, and hold harmless Kpop Velvet LLC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, and employees, from any claim or demand—including reasonable attorneys’ fees—made by any third party due to or arising out of:

    • Your Breach: Your violation of these Terms of Service or the documents they incorporate by reference.

    • Law Violations: Your violation of any law or the rights of a third party (such as intellectual property rights).

    • Site Misuse: Your improper use of the Site or any products purchased through it.

    • Mandatory Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in Waco, Mclennan, Texas.

    • Individual Capacity: You agree that any claims will be adjudicated on an individual basis, and you waive the right to participate in a class, collective, or representative action.

    • Small Claims Exception: Notwithstanding the above, either party may bring an individual action in a Texas Small Claims Court if the matter falls within that court’s jurisdiction.

    • Costs: Each party shall be responsible for their own legal fees unless the arbitrator determines the claim was frivolous.

    • U.S. Operation: The Site is controlled, operated, and administered by Kpop Velvet from our offices within the State of Texas, USA.

    • Compliance: If you access the Site from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use Kpop Velvet content accessed through the Site in any country or in any manner prohibited by any applicable laws, restrictions, or regulations.

    • Export Control: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

    • Right to Modify: We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website.

    • Responsibility to Check: It is your responsibility to check our website periodically for changes.

    • Acceptance: Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

    • Version Control: The "Last Updated" date at the top of this page will indicate when the latest modifications were made.
